Data Protection: Information about your rights
The provisions of the Data Protection Act 1998 give you the right to have access to, or obtain a copy of personal data held by the Council which relates directly to you. Additionally, in some circumstances you may have the right to have inaccurate data rectified, blocked, erased or destroyed.
These are powerful rights, and not surprisingly some exemptions do apply – for example, when the information is held for the purpose of detecting or preventing a crime it would not be appropriate to release the detail to the person involved! Wherever an exemption does apply, the Council will do its best to explain the circumstances.
If you wish to access information about yourself, you will need to make an application in writing. We have devised a form you can use, or you can simply write down all the information we need to process your request, and send it to us.
You should be as specific as you can in relation to what you want. Details of, for example, which Council Service you think holds the information you want to see, and what recent contact you have had with the Council will greatly assist our search outcome. It will also save time – we may have to come back to you with questions to clarify things if we are having difficulty locating what you want.
When making a request, we need to be sure that you are who you say you are – proof of identity will be required.
The process of locating requested information and replying to you can take some time depending on what you have asked for. The Council is however required to respond to you within forty days.
Please note the Council reserves the right to charge a fee of £10 sterling for this service.
