RIPSA / Covert Surveillance

Some activities of Services of this Council, including Trading Standards, are covered by the Regulation of Investigatory Powers (Scotland) Act 2000 hereafter described as RIPSA.

  • These activities which are deemed lawful if properly authorised, include carrying out covert surveillance or using covert human intelligence sources to uncover crime.
  • An independent inspection of the Council’s arrangements is carried out for the Surveillance Commissioner.
  • Anyone aggrieved at the activities of a public authority, like Clackmannanshire Council, can complain to an Investigatory Powers Tribunal set up under RIPSA.

The Council’s Legal Services maintain a Central Register of Authorisations. Services may be guided about the application of RIPSA by their own professional bodies, however they may clarify areas of concern and responsibility with Legal Services. Trading Standards can advise consumers and local businesses who may wish to know more about RIPSA.
