Informing Owners
Planning law requires that an applicant for planning permission must complete accurately, sign and date a declaration on the application form that they are either:
- the owner of all the land/buildings which are the subject of the application; or
- have served a formal notice on all owners of land/buildings the subject of the application 21 days prior to the date of the application.
If an applicant is uncertain if they own all of the application site or are unsure who to notify they should obtain legal advice as it is a criminal offence to knowingly or recklessly provide false information.
Notifying Neighbours
Planning law provides that for most categories of planning application the applicant must: serve owners and occupiers (including those with leases) of land and/or buildings neighbouring the application site with a formal Neighbour Notification Notice. IT IS THE APPLICANT WHO SERVES THIS NOTICE, NOT THE COUNCIL.
The Notice will give the neighbour the following information:
- name of the applicant;
- the location of the proposed development;
- a description of the proposal;
- a location plan of the application site;
- where the application form, plans and other submitted supporting information can be viewed;
- how and when representations may be made.
The applicant must declare to the Council formally on the application form that neighbour notification has taken place, listing those notified and showing their addresses on a submitted plan.
The application will not be processed until this information has been provided.

Applicants should arrange for neighbours to receive their Notices on the same day as the application is submitted to avoid inconvenience to those wishing to view the plans. Plans can be viewed on the UKPlanning Website or at the Development Services offices which are located at Kilncraigs, Greenside Street, Alloa, FK10 1EB.
When an applicant formally submits a MATERIALLY SIGNIFICANT change to an application or to plans the Council will require neighbours to be renotified. The degree of change may mean the withdrawal by the applicant of the original application and the submission of a new application.
